2  Consent orders for periodical payments [2 Periodical payments]

[(A1)ÌýÌýÌýÌý In cases where Regulation (EC) No 1371/2007 of the European Parliament and of the Council of 23rd October 2007 on rail passengers' rights and obligations applies, this section needs to be read in the light of Article 30 of the Uniform Rules concerning the contract for the international carriage of passengers and luggage by rail (damages to be awarded as annuity on request), as set out in Annex I to that Regulation.]

[(A2)ÌýÌýÌýÌý A court awarding damages for future pecuniary loss in respect of personal injury—

(a)ÌýÌýÌýÌý ³¾³Ü²õ³Ù—

(i)ÌýÌýÌýÌý consider whether to make an order under which those damages wholly or partly take the form of periodical payments, and

(ii)ÌýÌýÌýÌý have special regard to the pursuer's needs and preferences when doing so, and

(b)ÌýÌýÌýÌý may make such an order with or without the consent of the parties.]

(1)ÌýÌýÌýÌý A court awarding damages in an action for personal injury [in respect of personal injury (other than damages for future pecuniary loss)] may, with the consent of the parties, make an order under which
