FORTHCOMING CHANGES: An Equality and Human Rights Commission (EHRC) consultation running between 2 October 2024 and 3 January 2025 sought responses on a proposed update to the statutory Code of Practice on services, public functions and associations. The updates reflect significant developments in legislation and case law since the Code was first published in 2011. For further information, see: LNB News 02/10/2024 23 and Practice Note: Consultation tracker—Employment. This Practice Note will be updated when the updated Code of Practice is published.

This Practice Note considers the legal and human resources (HR) considerations for employers when dealing with staff who are transgender (trans) or identify as gender-neutral or non-binary. It considers protection from sex Discrimination and gender reassignment discrimination under the Equality Act 2010 (EqA 2010), gender recognition certificates (GRCs) under the Gender Recognition Act 2004 (GRA 2004), the Protection from Harassment Act 1997 (PHA 1997), the Human Rights Act 1998 (HRA 1998), trust and confidence, data protection issues, and the position in relation to toilet, washing and changing facilities.
