The Economic Crime and Corporate Transparency Act 2023 (ECCTA 2023) received Royal Assent on 26 October 2023.

Background to ECCTA 2023

On 5 May 2019, the Department for Business, Energy and Industrial Strategy (BEIS, now the Department of Business and Trade) published a consultation paper—Corporate Transparency and Registration Reform (Consultation on options to enhance the role of Companies House and increase the transparency of UK corporate entities). The consultation closed on 5 August 2019.

The consultation paper was organised into four key areas:

    Part A: knowing who is setting up, managing and controlling corporate entities—proposals included requiring individuals who have a key role in companies to have their identity verified—to apply to directors, PSCs and those filing information

  2. •

    Part B: improving the accuracy and usability of data on the Companies Register—proposals included giving Companies House enhanced powers to query and seek corroboration of information before it is entered on the register and to facilitate the removal of inaccurate information from the register

  3. •

    Part C: protecting personal information—the reforms suggested new processes to protect
