Who requires permission to travel to the UK?

Other than British or Irish citizens (or Commonwealth citizens with the right of abode) a person wishing to travel to the UK generally requires leave, ie permission, to enter (pass border control) and remain in the UK. Other persons who do not require leave to enter the UK are exempt persons (such as diplomats) and persons with a frontier worker permit.The position as regards prior permission to travel to the UK for persons who require leave to enter is changing further to the staged introduction of the Electronic Travel Authorisation (ETA) regime which commences from Autumn 2023. The ETA scheme is being rolled out by nationality and is intended to be fully in force by the end of 2024.The current position, prior to roll-out, is that, depending on their nationality, some non-British or Irish citizens require permission in all cases before travelling to the UK and, generally, all non-British or Irish citizens coming to the UK for more than six months require prior permission. Those with existing leave in the route are still be able to extend their stay, including making an application for entry clearance outside the UK if they have held leave as a Tier 1 (Investor) migrant in the 12-month period preceding the date of application, and apply for settlement. Online terms and conditions for the supply of services—business-to-consumer FORTHCOMING CHANGE: On 24 May 2024, the Digital Markets, Competition and Consumers Bill received Royal Assent, becoming the Digital Markets, Competition and Consumers Act 2024 (DMCCA 2024) and coming partly into force on that date. DMCCA 2024, s 251 (which is not yet in force) will revoke the Consumer Protection from Unfair Trading Regulations 2008 (CPUTR 2008), SI 2008/1277. Once revoked, the provisions presently contained in the CPUTR 2008 will be replaced by Part 4 of DMCCA 2024 (which largely replicates the requirements of the CPUTR 2008). The DMCCA 2024, Part 4, Chapter 2 (which is not yet in force) removes subscription contracts from the scope of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, SI 2013/3134 (CCR 2013). Where an employer intends to sponsor a new hire overseas under the skilled worker route, are there any workarounds in a situation where the new hire has a lengthy notice period (eg more than three months) with their existing employer and does not wish to resign before their visa is granted? For the purposes of this response, the sponsor will need to have a skilled worker licence to sponsor an employee. When assigning a defined Certificate of Sponsorship (CoS) to a worker, the sponsor must confirm the proposed start date of employment and the end date for sponsorship. However, anxious to have some certainty that relocation can go ahead, it is not uncommon for a proposed worker to want to wait until the visa is granted before handing in their notice. The following Immigration Rules are relevant to this situation: • the CoS must be assigned no more than three months before application • there can be no more than three months between the visa application date...
