Unliquidated damages definition

What does Unliquidated damages mean?

Unliquidated damages is where the court must quantify or assess the damages or loss, whether pecuniary or non-pecuniary.

A claim for unliquidated damages is a provable debt. The unliquidated damages may be a liability to which the bankrupt is subject at the commencement of the bankruptcy, or one to which he may become subject after the commencement of the bankruptcy by reason of any obligation incurred before the commencement of the bankruptcy Insolvency Act 1986, ss 382(1)(a)鈥382(1)(b).
