Are combined authorities by legislation required to have an internal audit committee? The process of devolution has resulted in power and control being passed from the government to local areas, the idea being to give local areas the power to effect change on issues such as transport and economic development. This is often achieved through the establishment of a 'combined authority'. These combined authorities are comprised of councillors from neighbouring, constituent councils that wish to group together to address local issues. Parliament has approved orders establishing city region mayor areas including Greater Manchester, the Liverpool city region, the Sheffield city region, the West Midlands and thea Tees Valley. What do I need to know about ICANN's new gTLD program? What is happening? The Internet Corporation for Assigned Names and Numbers (ICANN) oversees around 20 generic top-level domains (gTLDs) such as .com, .biz and .net. The new gTLD program heralds the introduction of thousands of new gTLDs. To date ICANN has released over 175 new gTLDs. ICANN is expected to release a further 2,000 domain names during the remainder of 2014. Around 40% of the gTLD applications are for brand names eg .bmw, .boots and the remainder are mainly generic words eg .book, .car or acronyms. The rationale behind this expansion is to encourage competition in the domain name market as organisations (companies, individuals, governments etc) may apply to operate their own gTLD registries. ICANN's initiative may be both an opportunity for brand owners to increase online presence and a potential problem as the scope for trade mark infringement via domain name registration (cybersquatting) appears limitless. Haemophilia gene therapy patent valid and infringed (Pfizer v uniQure)

IP analysis: The Patents Court rejected Pfizer’s revocation action against uniQure’s patent EP(UK) 3,581,650 (EP 650) which protects a ‘Factor IX polypeptide mutant and a method for its production’ and forms the basis for uniQure’s haemophilia drug ‘Hemgenix’. Consequently, Pfizer may not currently launch its own haemophilia gene therapy drug ‘Beqvez’ (approved by the European Medicines Agency on 24 July 2024) in the UK, but has indicated that it intends to appeal the decision. Pfizer, while admitting infringement should EP 650 be found valid, sought to argue that EP 650 was invalid. Pfizer’s case was that the specific amino acid substitution used in EP 650 was obvious and lacked an inventive step over a single piece of prior art. In reaching its findings, the Court was strongly influenced by ‘secondary evidence’ relating to what real world research teams were doing at the relevant time and was somewhat critical of Pfizer’s experts. Upper Tribunal directs FCA to reduce financial penalty in cum-ex trading case (Arian Financial LLP v FCA)

Financial Services analysis: Arian Financial LLP (the Applicant) referred a decision of the Financial Conduct Authority (FCA) to the Upper Tribunal which conducted a complete re-hearing of the issues underpinning the FCA’s decision to fine the Applicant £744,745, pursuant to s133(5) Financial Services and Markets Act 2000 (FSMA 2000). The Applicant admitted breaches of Principles 2 and 3 of the FCA’s Principles for Businesses but disputed the size of the financial penalty. The Tribunal considered that the FCA had not correctly followed its policy set out in its Decision Procedure and Penalties Manual (DEPP). The Tribunal made findings of fact, considered the five stages for determining the size of penalties at DEPP 6.5A (the Five-Step Framework), and directed the FCA to revise its decision with a determination reducing the financial penalty to £288,962. Of particular note is the Tribunal’s clarification of the meaning of ‘financial benefit’ for Step 1 disgorgement, as well as its guidance for approaching Step 4 multipliers by reference to the ratio between the disgorgement figure and...
