Environment Agency—powers to investigate environmental crime The Environment agency (EA) is one of the regulators responsible for the enforcement of environmental law and the prosecution of environmental crime in England. Other regulators responsible for environmental compliance and prosecution in England include local authorities and Natural England. Natural Resources Wales (NRW) is the responsible authority, for Wales, and the Scottish Environmental Protection Agency (SEPA) in Scotland. Terrorism law The law relating to terrorism in the UK is spread across both common law and statute and includes both a wide range of criminal offences and civil powers. The Terrorism Act 2000 (TA 2000) was originally intended to be a comprehensive framework for counter-terrorism powers. We have assumed that this Q&A relates section 82 of the Deregulation Act 2015 (DA 2015) which allowed the Criminal Procedure Rules Committee (CPRC) to include in the Criminal Procedure rules 2015 (CrimPR 2015), SI 2015/1490 rules relating to Police and Criminal Evidence Act 1984 (PACE 1984) investigation orders. Refusal to repurpose evidence in civil proceedings for criminal charging decision (WFZ v British Broadcasting Corp)

Dispute Resolution analysis: The High Court has recently clarified the circumstances in which a party will be allowed to rely on witness statements outside the original proceedings in which they are served. In ongoing injunction proceedings to prevent the publication of a BBC investigation report into sexual abuse claims, the court found that the accused should not be allowed to rely on sensitive extracts of that report when making his representations to the police to dissuade them from charging him. Mrs Justice Rice J held that such a decision did not violate the accused claimant’s Human Rights , as he would be able to rely on the report at trial. This decision is most useful in clarifying the circumstances in which the court will allow a witness statement to be used for an alternative purpose, both in civil procedure under CPR 32.12(2) and under the Police and Criminal Evidence Act 1984 (PACE 1984).
