AI brings "consistency" and "precision" to contract reviews, says in-house leader at Boston Consulting Group (BCG)

How is AI revolutionising legal functions and the broader business landscape?

Our recent survey of in-house legal practitioners found:

  • 97% of in-house lawyers are either using or planning to use AI for work purposes
  • 53% of in-house lawyers said their organisation is slow or very slow at implementing new technology.
  • 19% would consider leaving if their organisation didn't adequately invest in AI.

Emma Dickin, Head of In-house Practical Guidance Strategy at ÀÏ˾»úÎçÒ¹¸£Àû UK, sits down with Luis de Freitas, Director & Managing Legal Counsel at Boston Consulting Group (BCG), to explore how generative AI is transforming legal work and the importance of ensuring its ethical use across global teams.

AI is revolutionising legal work with BCG's strategic approach

Boston Consulting Group has been at the forefront of integrating AI into its operations, setting a benchmark for how in-house legal teams can leverage technology to enhance their functions. Luis de Freitas shares, "We've been using AI for a while now... we are using different tools internally from different teams." This strategic approach involves deploying AI tools that automate routine tasks, such as contract reviews, thereby boosting efficiency, saving time, and enhancing accuracy.

The legal team at BCG is currently testing several AI tools, one of which automates the contract review process. Luis explains, "Right now we have a few tools that we use that we are testing... a tool that helps us with the review of contracts and can automate the process to make it a bit quicker." By automating these tasks, in-house legal teams can focus on more complex and strategic issues, thereby increasing their overall productivity and value to the business.

Automating tasks to boost efficiency and accuracy

One of the most significant advantages of AI in legal departments is its ability to automate repetitive tasks, such as contract reviews. This automation not only speeds up the process but also reduces the likelihood of human error, ensuring greater accuracy in legal work. Luis highlights that BCG's legal team is leveraging AI to streamline these processes, allowing lawyers to dedicate more time to strategic decision-making and client interactions.

The use of AI tools in contract reviews is particularly beneficial in handling large volumes of documents, where manual review would be time-consuming and prone to errors. By automating these tasks, legal teams can ensure consistency and precision, which are crucial in maintaining compliance and mitigating risks.

Ensuring ethical use of AI across global teams

As AI becomes more integrated into business operations, the ethical use of these technologies is paramount. At BCG, responsible AI principles are deeply embedded in the company's ethos. Luis emphasises, "One of the things that we really care about at BCG is the responsible use of AI... we have set responsible AI teams." This commitment ensures that AI tools are used ethically and responsibly.

BCG's approach involves developing specific terms in contracts and compliance measures to address the ethical use of AI. This proactive stance helps alleviate fears and concerns associated with AI, ensuring that the technology is used in a manner that aligns with regulatory requirements and ethical standards.

Navigating challenges and ensuring leadership buy-in

Implementing AI tools in legal departments is not without its challenges. Luis notes that leadership buy-in is crucial for successful integration. "Leadership buy-in is really important... once they are invested, you can go to the team and share all the information," he advises. Having the support of top management ensures that the legal team can effectively communicate the benefits and potential of AI tools to the broader organisation.

Additionally, it is essential to have subject matter experts (SMEs) or enthusiasts within the legal team who can test and refine AI tools. Luis suggests, "You will have to have some sort of SMEs or enthusiasts within the legal team that will test the tool... and will make the information flow."

Global collaboration and overcoming regulatory hurdles

BCG's legal team operates globally, which presents unique challenges in rolling out AI tools across different jurisdictions. Luis explains, "Our legal team is a global team... we are trying to roll out the tool in a global way." This requires thorough testing to ensure the tool's effectiveness in various languages and legal contexts.

The global nature of BCG's legal team also provides an opportunity for cross-collaboration and information sharing. "We have lawyers creating custom GPTs to accelerate different processes within the legal team," Luis shares, highlighting the innovative solutions emerging from diverse perspectives.

However, navigating the regulatory landscape is a significant challenge, as AI regimes develop at different speeds across jurisdictions. BCG addresses this by having a dedicated responsible AI team and compliance team that continuously monitor new regulations. "We have our compliance team... always on the lookout for new regulations," Luis notes.

Conclusion: Embracing AI for a more efficient and ethical future

The integration of AI into in-house legal departments is transforming the way legal professionals work, offering unprecedented opportunities for efficiency, accuracy, and strategic focus. Boston Consulting Group's approach to AI serves as a model for other organisations, demonstrating the importance of strategic implementation, ethical considerations, and global collaboration.

As AI continues to evolve, in-house legal teams must embrace these technologies while ensuring their responsible and ethical use. By doing so, they can enhance their value to the business, navigate regulatory challenges, and contribute to a more efficient and innovative future for the legal profession.
