3.4 Severance pay | France

France

Severance pay in France is known as Indemnité de Licenciement, intended to compensate for an employee's loss of job. The amount to be paid may be determined by reference to either:

  1. Ìý

    •ÌýÌýÌýÌý the minimum values set out in the Labour Code,

  2. Ìý

    •ÌýÌýÌýÌý any relevant collective agreements that may be in force, or

  3. Ìý

    •ÌýÌýÌýÌý any relevant individual contractual agreements

The Labour Code allows for a severance payment to be due where the employee has at least one year of continuous service and the dismissal is for economic, personal or incapacity reasons, but not for gross misconduct or serious
