What does Adoption mean?

The process whereby a person assumes the parenting of a child and in so doing permanently has transferred to them all rights and responsibilities from the original parent or parents.

Following the making of an adoption order the parties who have secured such orders in respect of a child are regarded as the child's legal parents. On the making of such an order the birth parents lose parental responsibility in respect of the child which is conferred on the adopters.

This Practice Note sets out the general principles applied by the court in adoption proceedings including the paramountcy principle and the impact of delay in reaching decisions. It further considers the application of the welfare checklist, the range of available powers and that the court should not make an order unless to do so is better for the child.The general principles about adoption are contained in section 1 of the Adoption and Children Act 2002 (ACA 2002).
